Terms of use
Last updated 19 October 2026
The agreement between you and us. The parts most worth reading are what happens to your content, what a valuation in Kit Catalogue actually is, and what we are and are not responsible for.
1. Who this agreement is with
These terms are between you and NEWEX GLOBAL PTY LTD (ABN 83 703 303 682) of Level 9, Wyndham Building, 1 Corporate Court, Bundall QLD 4217, Australia. If you
are using Kit Catalogue for a business, “you” means that
business, and you confirm you are authorised to bind it.
They apply when you create an account, use the phone app or the web
app, or otherwise use the service. If you do not accept them, do not use
it.
2. Your account
You sign in with a single-use code sent to your email address, so
whoever controls that mailbox controls the account.
Keep it secure and tell us promptly if you think somebody else has got
in.
You are responsible for everything done under your account, and for
the people you invite to your organisation. An administrator can add,
change and remove members, and can close the organisation.
You must be at least 18 and able to enter a contract.
3. What the service does
Kit Catalogue builds an asset register from photographs. It
identifies what it can see, reads plates and serials, fills in
specifications, estimates a market value, applies a depreciation
schedule and projects that value forward. It exports the result.
It also prints labels you can stick on things, and lets you
publish two kinds of page from a record: a sale page for something
you are selling, and an instructions page for somebody standing in
front of the thing. What goes on either is your content, and
section 4 covers it.
We add and change features. We will not remove something you depend
on without telling you, but the service you get in a year will not be
identical to the one you get today.
Features described as coming soon are not part of what you are
paying for until they ship.
4. Your content
Your photographs and your register are yours. We
claim no ownership of them.
You grant us the licence we need to run the service: to store your
content, to process it, including by sending photographs to the
model providers listed in our Privacy page,
to display it back to you, and to export it at your request.
That licence ends when you delete the content or close the account,
except for backups ageing out and records we must keep by law.
We do not sell your content, and we do not give
anybody access to it except the model providers listed in our Privacy page, who process it in order to run
the service.
We may use your content to improve Kit Catalogue.
That includes your photographs and the records built from them, and it
includes training and evaluating the models the service uses to
identify, read and value equipment. We do not publish your content, we
do not identify your business in it, and we do not use it to make
decisions about you. If you would rather your account were excluded
from this, tell us and we will exclude it.
You promise that you have the right to upload what you upload, and
that doing so does not breach anybody else’s rights. You are
responsible for deciding whether you may photograph equipment or sites
that are not yours.
Some pages you publish yourself. A sale page and
an instructions page are published by you, when you choose to, and
the link to one works for anybody who has it. We do not write, check
or verify what you put on them. That matters most for instructions
and safety information: if you publish how to operate a machine, or
what the hazards are, those are your words and your responsibility,
and you should treat the page the way you would treat a notice fixed
to the machine itself. An instructions page set to your team only
still requires somebody to sign in; one set to public does not, and
anybody who scans the label or is sent the link can read it.
You can take either kind of page down at any time, which stops the
link working, including for anybody you have already sent it to.
5. Acceptable use
Do not use Kit Catalogue to break the law, to infringe somebody
else’s rights, or to catalogue assets you have no legitimate
interest in. Do not upload malware, attempt to breach our security,
scrape the service, resell access to it, or use it to build a competing
product.
Do not send us information about a person’s health, their
racial or ethnic origin, their political or religious views, or any
government identifier. The product has no use for it and we do not want
it.
Do not upload photographs of people. Kit Catalogue
is a register of equipment. Photograph the machine, not whoever is
standing next to it. You will usually not have the consent of somebody
caught in the background of a workplace photograph, and we are not the
right place for that picture to end up.
This is not left to good intentions. Every photograph is checked as
part of the analysis, and one showing a recognisable person is deleted
from our storage and removed from your record, and you are asked to
retake it. Section 3 of the privacy policy
explains exactly what that check does and does not do.
What you publish on a page of ours. A sale page
and an instructions page sit on our address and are read by people
who are neither your customers nor ours. Everything above applies to
what you put on them, and we may take a page down, or switch the
feature off for an account, if what is on it breaks these rules. We
do not check pages before they go up and we are not obliged to look
at them at all: this is a right we keep, not a service we provide.
Where we can tell you first we will, and where something has to come
down immediately we will tell you straight afterwards and why.
6. Valuations are estimates
A value in Kit Catalogue is an estimate produced by
software, not a valuation by a qualified valuer. It is not a
certified valuation, an appraisal, or a guarantee of what anything
will sell for.
Estimates are built from comparable listings and sales, adjusted for
what we can read about condition and usage. They carry a visible range
and a confidence rating, and the confidence rating is there because it
means something. Depreciation schedules are defaults for a category
unless you set your own, and a forecast extrapolates a schedule. It
is not a prediction of the market.
If a number matters, for an insurance schedule, a finance
application, a sale, a dispute or a set of accounts, check it,
and get a professional valuation where one is appropriate. You accept
that you use these figures at your own risk.
7. Not professional advice
Nothing in Kit Catalogue is tax, accounting, financial, insurance or
legal advice. Depreciation methods, effective lives and written-down
values are calculations from inputs you and we supply; whether they are
correct for your circumstances is a question for your accountant.
Insurance schedules are a document you can hand to your broker, not a
statement about whether you are adequately insured.
8. Plans, credits and billing
Each plan includes a number of items your register may hold and a
number of people who may use it. Both are a standing size rather than
a monthly quota: nothing about them resets, and you are not charged
for adding and removing the same item twice.
Going over what your plan includes
On a paid plan you are never stopped from adding an item or a
person. Past the numbers your plan includes, each additional item and
each additional user is charged monthly at the rates shown on our
pricing page, added automatically to your bill each month. There is
nothing to buy and nothing to switch on. The same applies on a plan
paid yearly: the plan itself is paid a year in advance, and anything
over it is billed each month at the monthly rates. The rates are
exclusive of GST, like every other price we quote.
Where there is a larger plan above the one you are on, the extra
charges for items and users together will never exceed the difference
in price to that plan. In other words, going over cannot cost you more than simply
moving up, and we will tell you when you have reached that point. On
our largest plan there is no plan above to measure against, so that
cap does not apply and the charge continues at the published rate.
The free plan cannot go over. There is no payment method on a free
account, so the item and user counts on it are firm limits rather than
charges, and you will be asked to move to a paid plan instead.
If your register grows past the size our published plans are built
for, we may offer you a customised arrangement. Asking us about one
changes nothing on its own: your plan, your rates and what you are
able to do all stay exactly as they were unless and until you agree
to something different in writing.
Analysis credits
Identifying and valuing an item consumes one analysis credit.
Adding photographs to a record, editing it, tagging it, exporting it
and looking at it cost nothing. Asking for a record to be analysed
again costs one credit, and we tell you before you confirm.
When you open an account we grant you one credit for every item
your plan includes, so you can catalogue the register you are paying for
without waiting. We add to that grant when your entitlement grows: if
you move to a larger plan, if you are given extra room, and for each
item you add beyond your plan’s count. These granted credits do
not expire while your account is open.
Beyond that, each plan includes a monthly allowance of analyses for
re-analysing items, refreshing values, and cataloguing replacements
for items you have removed. The monthly allowance resets each period
and does not roll over. Granted credits are kept back and spent only
once the monthly allowance is gone.
If you run out of both, your register stays readable, editable and
exportable, and you can still add items. You simply cannot have
anything newly analysed until the next period begins.
Renewal, cancellation and price changes
Paid plans renew automatically until cancelled. You can cancel at any
time, effective at the end of the period you have paid for. Fees already
charged are not refundable except where the law requires it, or where we
have plainly failed to supply what you paid for.
We may change prices, including the rates charged for going over
what your plan includes. Existing subscribers get at least 30
days’ notice before a change affects them, and may cancel
instead.
9. Availability
We aim to keep Kit Catalogue available and we monitor it, but we do
not promise it will be uninterrupted or error-free, and we do not offer
a service level agreement. Maintenance, faults and things outside our
control will sometimes take it offline.
The phone app is built to work without signal and to sync when it
comes back. That is a design goal, not a guarantee.
10. Ending it
You may stop using the service and close your account at any time.
Before you do, export what you want to keep: closing an account deletes
its register and its photographs, and we cannot get them back for
you.
We may suspend or end your access if you breach these terms, if we
are required to by law, or if your account is being used in a way that
threatens the service or other customers. Where it is reasonable to do
so we will warn you first and give you the chance to fix it. If we end
your account without cause, we will refund the unused part of anything
you have paid.
11. Our intellectual property
The service, the software behind it, the Kit Catalogue name and the
marks on this site are ours or our licensors’. These terms give
you a limited, non-exclusive, non-transferable right to use the service
while your account is open, and nothing more.
If you send us feedback or a suggestion, we may use it without
obligation to you. That does not give us any right to your register.
12. Confidentiality
Each of us may learn things about the other that are not public. We
will each keep those confidential, use them only for this agreement,
and protect them at least as carefully as we protect our own. This does
not apply to information that is already public, that we already knew,
or that we must disclose by law. If we are compelled to
disclose yours, we will tell you unless we are prohibited from doing
so.
13. Warranties and consumer guarantees
To the extent permitted by law, the service is provided
as is and as available, and we exclude
all implied warranties, including merchantability, fitness for a
particular purpose and non-infringement. We do not warrant that any
identification, valuation or forecast is accurate, complete or fit for
any particular purpose.
Australian consumers: our goods and services come
with guarantees that cannot be excluded under the Australian Consumer
Law. For a major failure you are entitled to a replacement or refund,
and to compensation for any other reasonably foreseeable loss. You are
also entitled to have the service remedied if it is not of acceptable
quality and the failure does not amount to a major failure. Nothing in
these terms excludes, restricts or modifies those rights.
Where our liability for breach of a non-excludable guarantee can be
limited, we limit it to resupplying the service or paying the cost of
having it resupplied.
Some other jurisdictions do not allow certain exclusions. Where that
is so, the exclusions above apply only as far as that law permits.
14. Liability
Neither of us is liable to the other for indirect, incidental,
special or consequential loss, or for loss of profit, revenue, goodwill,
data or anticipated savings, however it arises.
Subject to the consumer guarantees section above, our total liability
for all claims in any twelve-month period is limited to the greater of
the fees you paid us in the twelve months before the claim, or
AUD 100.
Nothing here limits liability that cannot be limited by law,
including for death or personal injury caused by negligence, or for
fraud.
You will indemnify us against claims brought by a third party arising
from content you uploaded that you had no right to upload, or from your
use of the service in breach of these terms.
15. GST and taxes
Unless we say otherwise, prices are exclusive of GST and of any other
tax or duty. Where a supply under these terms is a taxable supply for
the purposes of the A New Tax System (Goods and Services Tax) Act
1999 (Cth), you must pay the GST in addition to the price, and we
will give you a tax invoice.
If you are outside Australia, you are responsible for any tax that
applies where you are, and you must tell us if you are required to
withhold anything.
16. Changes to these terms
We may change these terms. If a change is material we will give you
at least 30 days’ notice by email or in the app, and it will not
apply retrospectively. Continuing to use the service after that is how
you accept it. If you do not, close your account and we will refund the
unused part of anything you have paid.
17. Governing law
These terms are governed by the laws of Queensland, Australia, without
regard to conflict-of-law rules. You and we submit to the
non-exclusive jurisdiction of the courts of Queensland and the courts
entitled to hear appeals from them.
Before either of us starts proceedings, we will each try in good
faith to resolve the matter by talking about it. This clause does not
require arbitration, does not waive any class action, and does not stop
either of us seeking urgent injunctive relief.
If you are a consumer, nothing in this section takes away a right to
bring proceedings in the place where you live, where your own law gives
you that right.
18. General
These terms, with the Privacy page, are
the whole agreement between us about the service. If a provision is
unenforceable, the rest survives. A delay in enforcing something is not
a waiver of it. You may not transfer these terms without our consent; we
may transfer them to a purchaser of the business.
Notices to you go to the email address on your account. Notices to us
go to the address below.
